Terms of Service

These Terms of Service (“Terms”) govern your use of the Dictaro application and related services (“Service”) provided by Dictaro (“we”, “our”, or “us”). By downloading, installing, or using Dictaro, you agree to these Terms.

1. Service Description

Dictaro is a voice-to-text dictation application for Windows that converts spoken language into text using local speech recognition. An optional Pro subscription adds AI-powered text post-processing features.

2. Account Terms

• Free Tier: No account is required to use Dictaro’s free dictation features.
• Pro Tier: An account is required for Pro features. You may create one account per person.
• Authentication: Accounts are created via OAuth (Google, GitHub, or Microsoft). You are responsible for maintaining the security of your OAuth credentials.
• Account Accuracy: You agree to provide accurate information when creating your account.

3. Free Tier

The Free tier includes:

• Unlimited voice-to-text dictation
• Support for all Whisper-supported languages
• Windows system tray integration
• Customizable hotkey control
• Local audio processing

The Free tier is provided at no cost, with no time limit, usage limit, or trial expiration. We reserve the right to modify Free tier features with reasonable notice.

4. Pro Tier Subscription

• Price: $9.99 per month (USD)
• Billing: Processed via Stripe. You agree to Stripe’s Terms of Service.
• Renewal: Subscriptions renew automatically each month unless canceled.
• Cancellation: You may cancel at any time. Your Pro access continues until the end of your current billing period. No refunds are provided for partial billing periods.
• Price Changes: We will provide at least 30 days notice before any price changes take effect.

Pro tier includes all Free features plus:

• AI text cleanup
• Professional tone mode
• Reformulation mode
• Grammar correction

5. Bring Your Own Key (BYOK)

Pro AI features use your own API key from a third-party AI provider (e.g., OpenAI, Anthropic).

• You are responsible for obtaining and managing your API key.
• Your use of third-party AI services is subject to that provider’s terms of service and usage policies.
• API usage costs from your AI provider are your responsibility and are separate from the Dictaro Pro subscription.
• Dictaro is not responsible for the output, accuracy, or availability of third-party AI services.

6. Acceptable Use

You agree not to:

• Use Dictaro for any illegal purpose or to generate illegal content
• Attempt to circumvent subscription requirements or licensing mechanisms
• Reverse engineer, decompile, or disassemble the Dictaro application
• Use automated tools to abuse, overload, or interfere with the Service
• Redistribute, sublicense, or resell Dictaro without written permission

7. Intellectual Property

• Your Content: You own all text produced through your use of Dictaro. We claim no rights to your transcribed or processed text.
• Our Software: Dictaro, its code, design, and branding are our intellectual property. Your license to use Dictaro is limited to personal or professional use per these Terms.
• Feedback: Any feedback or suggestions you provide may be used by us without obligation to you.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy for details on how we handle your information. Key points:

• Audio is processed locally and never transmitted to our servers
• We do not collect usage telemetry or analytics
• AI text processing uses your own API key via direct connection to your chosen provider

9. Disclaimer of Warranties

DICTARO IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Transcription accuracy — speech recognition accuracy varies by language, accent, audio quality, and environment
• AI text quality — AI text cleanup results depend on your chosen AI provider and model
• Availability — while we strive for reliability, we do not guarantee uninterrupted service
• Compatibility — we target Windows 10/11 64-bit but do not guarantee compatibility with all system configurations

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DICTARO AND ITS CREATORS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, or business opportunities
• Errors in transcription or AI text processing
• Actions of third-party AI providers accessed via your API key
• Damages exceeding the total amount paid by you to Dictaro in the 12 months preceding the claim

11. Indemnification

You agree to indemnify and hold harmless Dictaro and its creators from claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your use of third-party AI services via BYOK
• Content you generate using the Service

12. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of Dictaro after changes constitutes acceptance. For material changes, we will provide notice via the application or email (for Pro subscribers).

13. Termination

• By You: You may stop using Dictaro at any time. Cancel your Pro subscription through your account settings or by contacting us.
• By Us: We may suspend or terminate your access for violation of these Terms, with notice where practicable.
• Effect: Upon termination, your right to use Pro features ceases. Free tier features continue to function as they operate without an account.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of Dictaro shall be resolved through good-faith negotiation before pursuing formal legal proceedings.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Dictaro regarding the Service.
